TERMS AND CONDITIONS OF SALE

1. General Provisions

MAISON OMAEL has opened an online store offering its products for sale.

For any questions regarding an order, the Customer can contact MAISON OMAEL by email at contact@maison-omael.com or by phone at +33 (0)7 67 75 27 74 between 9:30 a.m. – 12:00 p.m. and 2:00 p.m. – 6:30 p.m.

These General Terms and Conditions of Sale (hereinafter referred to as “T&Cs”) apply to all orders placed for delivery to the following countries: Mainland France, Germany, Belgium, Spain, United Kingdom, Italy, Switzerland, Portugal, the Netherlands, and Luxembourg.

The T&Cs exclusively govern the offer and acceptance of product orders, as well as payment, delivery, and potential returns for products ordered by the Customer through the online store.

The Customer expressly and irrevocably accepts the terms of these T&Cs when confirming an order.

The Customer agrees that proof of T&C acceptance is constituted by checking the box “I have read and accept the General Terms and Conditions of Sale.”

The T&Cs applicable to the customer are those accepted at the time the order is confirmed.

MAISON OMAEL reserves the right to modify its T&Cs at any time.

The Customer may print, download, and keep a copy of these T&Cs on paper or electronic storage.

2. Product Presentation and Description

MAISON OMAEL has developed a unique concept of two-part plates, consisting of a base plate made from eco-resin and a Limoges porcelain center designed to fit securely onto the base plate.

These base plates are decorative items and are not intended to hold food directly; they should be used either with MAISON OMAEL’s porcelain centers or with any other standard container (plate, bowl, etc.) belonging to the Customer.

MAISON OMAEL also offers a concept of luminous display plates, featuring a rechargeable USB-C electronic unit with a finely engraved translucent plate displaying a design (drawing, logo, etc.). The light source in the unit highlights the engraving. The Customer may order a custom engraving of their chosen design. MAISON OMAEL reserves the right to refuse any engraving request that is obscene, illegal, immoral, or offensive. The logo for engraving must be free of any copyright, which the Customer explicitly acknowledges before confirming the order.

The products offered by MAISON OMAEL are handmade in France with artisanal expertise. Each product is unique and may not perfectly match the product displayed on our website www.maison-omael.com or any other platform, particularly in terms of color or decoration placement.

Product visuals and descriptions do not in any way commit MAISON OMAEL’s responsibility and do not entitle the Customer to any claims.

3. Product Availability

MAISON OMAEL’s collections are produced on an ongoing basis.

MAISON OMAEL manufactures products to order, based on its real-time production schedule. The production time is generally 4 to 6 weeks. The exact time frame is provided to the Customer after the order is confirmed. Should an unforeseen event extend this time frame, MAISON OMAEL will inform the Customer as soon as possible.

4. Sales Prices

Prices are expressed in euros, inclusive of VAT, but excluding delivery charges and customs duties.

Any applicable delivery charges are the responsibility of the Customer and are billed in addition to the product price.

MAISON OMAEL reserves the right to change prices at any time, but any changes will not affect previously placed orders.

5. Delivery Fees and Taxes

Products are delivered to the address provided by the Customer during order confirmation, provided it is within the covered delivery areas: Mainland France, Germany, Belgium, Spain, United Kingdom, Italy, Switzerland, Portugal, the Netherlands, and Luxembourg.

For delivery to countries not listed, the Customer should contact Maison Omaël’s customer service by email at contact@maison-omael.com or by phone at +33 (0)7 67 75 27 74.

Deliveries are handled by carriers according to the destination country.

The Customer is notified by email of the shipment date of their order.

In the event of an incomplete or incorrect delivery address, re-shipment costs are the responsibility of the Customer.

The Customer assumes full responsibility for the products upon receipt.

Any shipment or delivery delays will be communicated to the Customer by email.

Upon delivery, the Customer must inspect the packaging and verify the products ordered. If there is visible damage, it is recommended that the Customer refuse the package from the carrier and notify both the carrier and MAISON OMAEL.

MAISON OMAEL cannot be held liable for delivery delays resulting from the Customer’s unavailability after several proposed delivery dates/times from the carrier.

For Mainland France:

For orders under one hundred (100) euros, a flat fee of fifteen (15) euros is charged for transport. For orders over one hundred (100) euros, delivery is free of charge.

For EU Countries:

A flat fee of twenty (20) euros is charged for delivery. Following Brexit, VAT is collected by the carrier when the package arrives in the UK.

For Switzerland:

A flat fee of twenty-five (25) euros is charged for delivery. For orders outside the EU, customs fees may apply in the destination country and are to be paid by the recipient upon arrival.

6. Ordering

To facilitate ordering and future orders, the Customer can create a personal account on www.maison-omael.com.

This account enables automatic identification for each new order, provided the login and password are entered.

To register, the Customer must complete the fields in the “Create my account” section.

An email confirming the account creation is automatically sent to the Customer.

The Customer may modify personal information (password, address, etc.) at any time.

To place an order, the Customer should visit our website www.maison-omael.com.

The Customer can view each product on the product page and select items by clicking “Add to Cart.”

Additional items can be purchased by clicking “Continue Shopping.”

At any time, the Customer can view the selected items by clicking on “My Cart.”

The Customer then clicks “Confirm my Order” to finalize the purchase.

The Customer can review and correct the order in the “Order Summary” before final confirmation.

Once confirmed, an order is final and signifies full acceptance of these T&Cs.

An order confirmation email is sent, containing:

– Order number – Billing address – Shipping address – Order summary (description of ordered products, quantity, price, reference) – Total order amount – Delivery charges – Payment method and payment status.

The Customer pays online by credit card (CB, Visa, Mastercard, or American Express). Payments are secured through MAISON OMAEL’s financial partner, Crédit Agricole (3D Secure).

To pay, the Customer enters the credit card number, expiration date, and security code on the back of the card.

The Customer’s bank account will be debited within a maximum of seven (7) days after order confirmation.

The Customer may also choose to pay by bank transfer.

Payment validates the order.

7. Order Refusal or Cancellation

MAISON OMAEL reserves the right to refuse or cancel an order for valid reasons, as per Article L. 121-11 of the Consumer Code.

Order refusals or cancellations for valid reasons do not entitle the Customer to compensation but to a refund of the product price.

This may occur for reasons such as:

– Product unavailability – Inability to fulfill the order and/or deliver (incomplete contact or delivery information) – Fraudulent use of bank data.

8. Returns and Exchanges

The Customer has a maximum of fourteen (14) days from receipt to return products if dissatisfied. After this period, items cannot be exchanged or refunded.

Only products purchased on MAISON OMAEL’s online store can be returned or exchanged. Customized items cannot be returned or refunded.

Items must be returned to: MAISON OMAEL, 30 rue des Bourguignons, 91230 Montgeron, at the Customer’s expense.

All returned items must be intact and in their original packaging.

MAISON OMAEL reserves the right to refuse returns if items appear damaged or depreciated.

If the conditions are met, MAISON OMAEL will exchange or refund returned products within fourteen (14) days of receipt.

9. Personal Data

MAISON OMAEL uses the Customer’s personal data to manage orders and delivery.

In compliance with the French “Data Protection Act” No. 78-17 of January 6, 1978, as amended by Law No. 2004-801 of August 6, 2004, the Customer has the right to access, modify, rectify, and delete personal data.

10. Force Majeure

MAISON OMAEL’s obligations are suspended in the event of force majeure, meaning any unforeseeable and irresistible event outside MAISON OMAEL’s control that hinders or delays the fulfillment of obligations.

Force majeure includes, but is not limited to, war, riots, social unrest, disasters, fires, strikes, internal or external failures, and other unforeseeable, external events that compromise order and delivery fulfillment.

11. Dispute Resolution

These T&Cs are governed by and interpreted in accordance with French law.

If an amicable solution cannot be reached between the Customer and MAISON OMAEL, French courts will have exclusive jurisdiction over disputes resulting from the interpretation or application of these T&Cs.
